Daytona Beach Commercial DUI Attorney
Let Us Help You Defend Your License
Driving under the influence of drugs or alcohol is a serious charge in
the state of Florida. However, the punishment for a conviction usually
results in the loss of driving privileges. For people who depend on operating
commercial motor vehicles (CMV) for a living, this loss of a driver’s
license could prevent them from working their regular jobs, resulting
in a loss of income.
If you’re a commercial driver who is under threat of losing their
commercial driver’s license (CDL), don’t hesitate to talk
to one of our skilled
Dayton Beach criminal defense attorneys as soon as possible. The sooner you call us, the faster we can get to
work investigating your case and looking for ways to poke holes in the
prosecution’s case.
Penalties
The most concerning punishment for being accused of a DUI is the loss of
a commercial driver’s CDL. Florida will suspend a driver’s
CDL if they are caught driving a commercial vehicle with a blood alcohol
content (BAC) of 0.04% or higher. The suspension will last about 1 year,
and the driver will be ineligible for a hardship license. If, however,
the driver was transporting hazardous materials at the time of the conviction,
the CDL will be suspended for a minimum of 3 years.
Requesting a Hearing
If your CDL was suspended for failing or refusing a BAC test, you might
be able to request a hearing to contest your suspension. You or your attorney
will need to request a hearing with your local Florida Department of Highway
Safety and Motor Vehicles (FLHSMV) Bureau for Administrative Reviews office
within 5 days of your arrest. Time is of the essence in this type of case.
